Terms and Conditions These are Motaman (Bristol) Ltd.'s (herein "Motaman") Online Store
Terms and Conditions of Sale to which all online purchases are subject.
We reserve the right to change these Terms and Conditions at any time,
without notice. Any changes will take effect when posted on this
website. By using this website you agree to be bound by these Terms and
Conditions.
These Terms and Conditions do not affect your statutory rights.

The Contract
Acceptance
of your order and the completion of the contract between us (Motaman)
and you (the customer) will take place when the goods have been paid
for by you and despatched by us. Any e-mail, order confirmation or
other electronic acknowledgement by us of receipt of an order does not
constitute legal acceptance by Motaman of your order. In the event that
there are any errors regarding price or description, we reserve the
right to notify you as soon as possible and give you the option to
proceed with this revised order at the correct price or description, or
to cancel the order. In these circumstances, upon cancellation, your
credit/debit card will be refunded in full.
Price Information
The
prices shown are only applicable to purchases made via the Motaman
Online site. On occasions the prices payable and promotions offered
online may differ from those prices and promotions offered at the same
time in Motaman stores. We are under no obligation to honour any in
store price or promotion that differs from those online. Similarly,
Motaman stores are under no obligation to honour any online price or
promotion that differs from the in store price.
Where the in store price is listed this refers to the current price in Motaman stores.
Special
Offers and promotions advertised in the press or other media may be
excluded unless specifically advertised as available online.
All offers are subject to availability and while stocks last.
All
prices are shown in £ sterling and include VAT where appropriate. We
regret we are not able to offer VAT exclusive pricing for deliveries to
the Channel Islands.
If an administrative error has resulted in
an incorrect price being displayed, we reserve the right to correct
that price and notify you accordingly. In these circumstances, it will
be deemed that a contract has not been entered into and you will not be
bound to continue with your purchase. You will be asked to email us to
confirm that you wish to proceed at the correct price, however, should
you choose not to do so, your monies will be refunded to your
credit/debit card in full. The repayment of such monies paid to us will
be the extent of our liability to you in the event of pricing errors.

Ordering Goods
To
order goods from our online store, you need to select your required
items from the product information page(s) on which they appear. These
pages can be accessed by selecting one of our main product categories,
either from the top navigation bar or from the list of categories and
sub-categories displayed on the centre of your screen.
To place an order online, go to the product information page and then follow the steps outlined below.
Product
Information Page: Check the availability of the product. Any product
that is out of stock will be labelled as such in the item description.
As we sell products in our high street stores aswell as online,
in-store sales may occasionally exhaust stock levels before we are able
to update our online records. If the item is in stock, click the 'Buy
Now' button on the product information page.
Shopping Basket
Page: After making your selections, click on the 'Checkout' button to
proceed with your order. You will be able to review and amend your
order before proceeding through the checkout pages. You can also click
"continue shopping" if you wish to shop for other items.
Billing
Page: The site will then prompt you to enter your billing address and
the address you would like the goods delivered to. You must enter your
billing address - this MUST be the address at which your credit/debit
card is registered - and e-mail/telephone contact details, so we can
contact you if we need to discuss your order.
Motaman is able to
receive online payment via Paypal or via RBS Worldpay. Select which
Payment method you wish to use and select "make payment".
Motaman
will confirm receipt of your order by sending an e-mail to you, using
the address you supplied when registering with our website. This e-mail
is only an acknowledgement and does not constitute legal acceptance by
us of your order.
All orders placed on the Motaman website are
subject to stock availability and to the validation checks described in
section 4 below. Also please refer to section 1 above regarding
incorrect prices. No contract will exist until payment has been
received and goods have been dispatched. This will be deemed to be our
acceptance of your order and to have been effectively communicated to
you. Please note that the only language in which the contract can be
concluded is English. Details of your order will be retained by Motaman

Payment
We accept payment by most major credit or debit cards registered at UK addresses.
Please
ensure that the expiry date of your credit/debit card is after the
anticipated despatch date of your order. Payment will be debited from
your account just before the despatch of your goods, and if your
payment card has expired, we will be unable to take payment and fulfil
your order.
We regret that we are unable to accept payment by
cheque, cash, purchase orders or any means of payment other than credit
or debit cards.
Validation Checks
All
credit and charge card holders are subject to validation checks and
authorisation by the card issuer. If the issuer of your payment card
refuses to authorise payment to us, we will not be liable for any delay
or non-delivery.
In addition, in the interests of preventing
fraudulent use of credit, debit and charge cards, Motaman uses World
Pay to make the financial transaction. This third party will make any
necessary checks to verify your purchase. This measure is taken to
ensure a safe and secure transaction for you and for Motaman.
Liability
The
majority of card issuers cover all the charges that may result from
unauthorised use of your credit or debit card, but some may limit your
liability to £50. If you believe your credit or debit card has been
subject to unauthorised use, you should contact your card issuer
without delay.
Delivery of Goods
Goods can be delivered either to your home address, to an alternative address or to your work.
Where
payment is made by phone, delivery can only be made to the billing
address associated with the credit or debit card used to make the
payment.
Your order will be delivered by courier service, or
whichever delivery service we believe to be most appropriate at the
time of despatch.
Delivery Charges
How much does delivery cost? Present charges are as follows:
The
majority of items listed on this website are provided with Free UK
Delivery. However charges are made on heavier and high value items.
These are as follows:
Small Package = £4.99 Medium Package = £7.99 Large Package = £9.99
These charges increase according to the quantity of items ordered. The increases begin when more than 10 items are ordered.
Motaman reserves the right to alter these charges, where circumstances outside of our control make it necessary.
Delivery Times
Standard delivery is by a 24 hour courier service, or in the case of smaller items, by 1st class recorded delivery post.
Customer
orders will be shipped on the same day as the order is placed with us
provided they are placed before 3pm, arriving with the customer via
courier on the next business day, or 24-48 hours later if delivered via
1st class post. Overseas deliveries will be assessed on an individual
basis. We reserve the right to alter or amend delivery times in
exceptional circumstances.

Risk in the goods will pass to you on delivery.
We
do everything we can to meet the delivery time specified in this
section however, in exceptional circumstances, delivery times may be
affected by factors beyond our control and cannot be guaranteed. We
will inform you if we become aware of an unexpected delay.
Delivery
times may vary, depending on stock availability and delivery location,
but we will endeavour to keep to quoted delivery times as much as
possible.
Restrictions on Ordering and Delivery
All
goods are subject to availability. Where a person attempts to buy goods
where minimum age limits apply, the contract will be deemed void where
the individual is below the required age limit.
Complaints and Queries
If
you are not happy with any aspect of our online service, discover a
fault with our website, or if you have any queries or comments relating

Your access to the Motaman website may occasionally be
restricted to allow for the introduction of new products or features,
site development, maintenance or repairs. We will attempt to restore
the service as soon as we reasonably can.
Unwanted Goods
If
you decide that you do not want any item that we have delivered, we are
happy to offer you an exchange or refund within 28 days of delivery,
provided that it is returned to us in its original and unused condition (including its original packaging) along with the wrapping and delivery note (as proof of purchase).
Personalised products and made-to-order products cannot be returned unless faulty.
Method of return
Items
purchased online should be returned to the Head Office address quoted
above, including a copy of your invoice. We are unable to refund any
costs incurred in returning items for refund.
Please note:
Satellite Navigation systems/units CANNOT be returned unless they are
complete with their original packaging WITH ALL SECURITY SEALS INTACT.
Colours, Specifications, Weights & Sizes
Representations
of colour online are as accurate as our photographic and electronic
processes will allow. Please note that colour online can also be
affected by the calibrations of different output devices.
We reserve the right to alter any product specifications without prior notice.
All weights and sizes are supplied as a guide only and are approximate.
Safe Shopping Guarantee
We have used every effort to ensure that shopping on the internet with Motaman is as safe as possible.
Although
we endeavour to take all reasonable steps to protect your personal
information, we cannot guarantee the complete security of any data you
disclose online. You accept the inherent security risks of providing
personal information and dealing online over the internet and Motaman
cannot be held responsible for any breach of security unless it is due
to our negligence.
